Mcdonald's Franchise Faces Lawsuit After Bronx Woman Is Burnt By Cup Of Hot Tea

(Thursday, July 30, 2009) - A Bronx woman is suing the owner of a McDonald's franchise for a disastrous visit to a drive-through that left her severely burned.

Miriam Richardson, who ordered breakfast and two hot teas at a Mount Vernon McDonald's drive-through around 8 a.m. on Feb.10, says in papers filed in Bronx Supreme Court Wednesday that both of the lids weren't secured properly.

Both cups of scalding liquid spilled onto her lap, burning her upper thigh and sending her to the hospital, according to her lawyer, Norman Block. This left permanent scars, Block said.

He said his client's case differs from the highly publicized $640,000 hot coffee lawsuit that proved McDonald's was serving its coffee at very high temperatures.

"You are supposed to seal them in the carton so they don't topple over," said Block.

Richardson is suing Penn Restaurant Inc. of Armonk, the owner of the McDonald's, for an undisclosed amount.

Peter Samaha, owner of the Mount Vernon McDonald's, said, "We take these allegations seriously. We caution anyone from jumping to conclusions without having all the facts."
