(Saturday, April 15, 2006) - OFFICIAL RULES: "I WANT TO WIN A NEW A/C SYSTEM" "PICK ME FOR THE A/C" Posted: 4/15/2006 12:00:00 AM EST Contest Dates: April 15– July 15, 2006 CONTEST SUMMARY The qualifying period for the Contest is Sunday, April 15, 2006, through Saturday, July 15, 2006, with the Contest Prize winners selected on or before July 17, 2006. By participating in this Contest, entrants agree to the specific rules, terms and conditions as stated herein. NO PURCHASE NECESSARY TO ENTER. Purchase will not improve chances of winning. The Sponsors of the Contest are One Hour Air Conditioning Franchising, LLC, ("One Hour Air Conditioning") and the Participating Franchisees noted below ( collectively referred to as the "Sponsors"). HOW TO ENTER There are two ways to enter the Contest: (1) Send an e-mail to freeac@onehourair.com that contains the words "Win A Free A/C" and also contains your full name, the mailing address (including state and zip code) of your legal residence and daytime telephone number; or (2) mail a standard size postcard or a letter inside a standard size envelope that contains your full name, the mailing address (including state and zip code) of your legal residence and daytime telephone number to: "Win A Free A/C", addressed to PO Box 46813, Las Vegas, NV 89114. One entry per household. All entries and entrants must meet other Contest rule and eligibility requirements. All Contest entries become the property of the Sponsors and the Sponsors may use any of the entries and/or any information contained therein for any purpose whatsoever, without further notice or compensation to the entrant. In the event that the entrant does not want to receive any further contact from the Sponsors other than possible notification of winning a Prize, the entry should indicated in bold letters I DO NOT WANT TO BE CONTACTED FURTHER. GENERAL ELIGIBILITY AND ODDS OF WINNING NO PURCHASE NECESSARY TO ENTER. Purchase will not improve chances of winning. Void where prohibited. Must be 18 years of age or older to enter, qualify, and/or win except as otherwise required by law. This Contest is open only to eligible persons who live in the specific states/zip codes covered by the Specific Participating Franchisees as noted below and who meet other qualifications for entry and/or winning the Prize as noted in the Rules. The Contest is not open to and any attempted entry is void from (a) any person who is not eligible to enter the Contest and/or to receive the Prize and (b) employees of the Sponsors, and their affiliates, subsidiaries, and successor companies, advertising and promotion agencies, Contest Prize suppliers, participating advertisers and immediate family members of anyone so situated. HOW TO WIN Each Specific Participating Franchisee shall award one Prize on or before July 17, 2006 after a random selection is made by One Hour Air Conditioning from all qualified entrants who reside within the specific state/zip codes covered by that Specific Participating Franchisee. Prize winners do not have to be present to win. A representative of the Sponsors will notify each Prize winner by phone, mail and/or email. If the first person selected to win each Prize is not eligible or elects not to accept the Prize, a drawing from the remaining qualified entrants who reside within the specific state/zip codes of that Specific Participating Franchisee will be conducted by One Hour Air Conditioning to determine the Prize winner. This process will continue until a Prize winner is selected from the remaining qualified entrants who reside within the specific state/zip codes of that Specific Participating Franchisee. Once selected and after installation of the Prizes, the Prize winners will be listed on www.onehourair.com. You may write to One Hour Air Conditioning at the address noted below to receive the names of each Prize winner after the names of all winners are listed on www.onehourair.com. Only one Prize shall be awarded by each Specific Participating Franchisee. FAIR MARKET VALUE OF PRIZE Approximately $4,500.00. See below for further details. PRIZE The Prize is the replacement of: (1) one existing split system central air conditioning unit not to exceed three tons; (2) one existing associated condenser unit; (3) one existing associated coil; (4) and one existing associated air blower along with customary and typical labor and minor parts associated with the installation of same. Please note that the exact types, specifications and model(s) of any part or piece of equipment to be installed as part of the Prize will depend on the size of house and other factors and any decision of the Specific Participating Franchisee regarding same shall be final. Any other installation, parts, labor, incidentals that are not part of the Prize but may be required to complete the installation of the Prize will be the responsibility of the Prize winner. Upon completion of installation of the Prize, the Specific Participating Franchisee shall give the Prize winner any documents that represent any manufacturer's warranty that may be available on the Prize or any part of the Prize. If an extended warranty is available at additional cost, the Prize winner may be notified of its availability and cost but it is not necessary for the Prize winner to enter into any extended warranty to receive the Prize. Please note that the exact types, specifications and model(s) of any part or piece of equipment to be installed as part of the Prize will depend on the size of house and other factors and any decision of the Specific Participating Franchisee regarding same shall be final. To be eligible to receive the Prize, the winner must also: own and occupy a single family stand-alone residence; already have installed in the residence a central air conditioning unit with already installed duct work; agree to pay for any additional installation, parts, labor and/or incidental charges that are required to install the Prize but are not included in the Prize; and present satisfactory evidence of creditworthiness in the event that the Prize winner will be responsible for any additional installation, parts, labor and/or incidental charges that are required to install the Prize but are not part of the Prize. Prizes are non-transferable and non-exchangeable. No substitution or cash equivalent will be made. HOW TO CLAIM THE PRIZE Each Prize winner must: (a) sign any forms and/or agreements required by the Sponsors that are either specified in the Rules or as may be required in the future, (b) must enter into a written agreement with the Specific Participating Franchisee that covers all of the terms and conditions regarding the installation of the Prize no later than 30 days after being notified and (c) each Prize winner must thereafter cooperate, arrange and permit the Specific Participating Franchisee to install the Prize no later than 90 days after being notified or else the Prize will be forfeited and the winner no longer eligible to receive the Prize. Each Prize winner must also (as requested) provide proof of eligibility to receive the Prize, proof of age, photo identification and a valid taxpayer identification number or social security number before the Prize will be awarded. The only accepted types of photo identification are government issued photo identifications, including a valid driver's license or United States passport. The Sponsors reserve the right to deny awarding any Prize if the winner fails to provide satisfactory proof of any Contest or Prize requirement, as determined in the Sponsors' sole discretion. In addition, each winner must agree to execute an affidavit of eligibility, indemnification and release of liability before the Prize is awarded. Failure to execute any of these documents or comply with any other the terms will result in forfeiture of the Prize. Each Specific Participating Franchisee reserves the right, in its sole discretion, to award an unclaimed Prize to alternate eligible entrants or not to award an unclaimed Prize. All federal, state and local laws and regulations apply. In the event that any required federal, state or local permissions, permits or licenses are required to be obtained in order for the Prize to be awarded and installed for a specific winner, the Specific Participating Franchisee will make a reasonable effort to obtain any such required permission, permit or license and will pay up to the sum of $100.00 for any required permission, permit or license (the Prize winner responsible to pay any amount in excess of that). In the event that the Specific Participating Franchisee is unable to obtain the required permissions, permits or licenses after making a reasonable attempt, then the Prize will be forfeited and that winner will no long eligible to receive the Prize. All federal, state and local taxes (including any sales taxes) are the sole responsibility of each Prize winner. Any person winning over $600 in prizes during any one year period will receive an IRS form 1099 at the end of the calendar year, and a copy of such form will be filed with the IRS. The amount reported to the IRS for income tax purposes will be the fair market value of the Prize at the time the Prize is installed, or as soon thereafter as an accurate determination of value can be made. Fair market value is determined by each Specific Participating Franchisee in its sole discretion. Any additional costs relating to any Prize or incurred as a result of accepting any Prize, are the sole responsibility of each winner. In addition, each Prize winner will be required to sign, among other documents, (a) a liability release form relieving the Sponsors from any liability for damage or harm winner might incur in claiming, installing or using the Prize and, unless prohibited by law, (b) a release giving the Sponsors the right to use that Prize winners' name, voice, photograph, and/or likeness for promotional/publicity purposes at any time without advance permission or knowledge required, and without additional compensation or limitations. LIMITATIONS The Sponsors reserve the right to make any final decision in all matters regarding the Contest, the Rules, the Prize and/or the Prizes. Due to unforeseen circumstances, which can arise from time to time, the Contest may be discontinued at any time during the Contest period without the Sponsors incurring any obligation, cost, liability, responsibility or damage to any entrant. The Sponsors and their respective parent, subsidiary, and affiliated companies, officers, directors, agents, or employees are not responsible for any expenses that any Prize winner may incur due to illness, injury, or loss of life in claiming, installing or using the Prize. The Sponsors are not responsible for the late, misdirected, lost, misplaced, illegible, mutilated or postage-due entries for any reason, including electronic or computer malfunctions that may affect the delivery or content of the entry, nor are they liable for any injury or damage to entrant's or any other person's computer or hardware related to or resulting from participating in or downloading any information necessary to participate in the Contest. Entrants must accurately and legibly complete all required information or entry will be deemed invalid. The Sponsors shall have no liability for any malfunction of the Internet, our website or any other computer-related processor system.
